Terms and Conditions

• 'Product' means any product we offer for sale through our website or via other means. It includes documents for which you buy a licence to use in accordance with these terms and conditions.

• 'Service' or 'Services' means all the services we provide, whether or not from our website. It includes courses for which you buy a licence to use in accordance with these terms and conditions.

This page (together with the documents referred to on it) tells you the terms on which we supply any of our courses (Services) or products (Products) to you. Please ensure that you read these terms of supply carefully before ordering any of our Services or Products.

By ordering any of our Services or Products, you agree to be bound by these Terms of Supply. If you refuse to accept these terms of supply, you will not be able to order any of our Services or Products.

Although our Services and Products are suitable for children, we sell to adults. If you are under 18 years of age, please ask your parent or guardian to make any purchases on your behalf.  By placing an order with us, you warrant that:

• you are legally capable of entering into binding contracts; and

• you are at least 18 years old.

You should browse the details provided on our website, and any supporting documents, to ensure that you are satisfied that the Product or Service you have selected is suitable and satisfactory for your requirements.

When you click to buy a Product or Service from us, in law you are offering to buy. Your contract with us is made only when one of the following happens:

• we send a Product to you

• we authorise you to download a Product

• we authorise you to access a Service, such as an online course.

The contract between you and Study Smiles Ltd will consist of these terms and conditions, your payment and our verification.  You should print out and retain copies of these elements forming the contract between us.

Courses and products sold by Study Smiles Ltd are all in digital format. This means that if you change your mind after purchase, you are not entitled to a refund as digital products do not fall within the ’14 day cooling off period’ under UK Law as you gain immediate access to the digital products.

However, we want you to be happy with any Services or Products you purchase from us. So, if you have an issue with any of the Services or Products you have purchased from us, please email info@studysmiles.co.uk and we will get back to you as soon as possible to try to resolve the issue.

We may close Facebook groups, remove individuals from Facebook groups and refuse membership to Facebook groups at our discretion and without notice. Facebook groups are free bonuses and do not constitute a paid element of a Product or Service.

Permission is granted to access or use our Services and/or Products for educational purposes by licence. Any purchase is for the grant of a licence not a transfer of ownership. The permissions associated with any licence is dependent on the product.

Products User Licence (e.g. purchase of documents)

A licence for documents purchased through our website is for an indefinite period unless otherwise specified.

You are permitted to:

• retrieve and display the course content on a computer/mobile screen for personal, educational non-commercial purposes. This includes teachers displaying PowerPoint Teaching Slides in a classroom.

• download and store purchased pdf documents on computer, mobile or external data storage (such as USB flash drive) for personal, educational and non-commercial purposes.

• modify for own use, but must not remove the Study Smiles logo or copyright information.

This is the grant of a licence, not a transfer of title.

​Under this licence you may not:

• reproduce, publish or sell any of the materials or part there of

• use the materials for any commercial purpose

• redistribute or share the materials with anyone either digitally or by hard copy

• remove any copyright from the materials

• remove the Study Smiles logo

• retrieve, print or share any content with or for anyone

• permit or enable a third party to do any of these acts.

All content of our Products remains our Intellectual Property.
Any licence granted shall automatically terminate if you violate any of these restrictions and may be terminated by Study Smiles Ltd at any time.

Service User Licence (e.g. purchase of courses)

Permission is granted to access our Services and/or Products online through the Thinkific Platform for a period of up to 2 years unless specified otherwise or agreed to be extended.

You are permitted to:

• retrieve and display the course content on a computer/mobile screen for personal, non-commercial transitory viewing only.

• download and store permitted pdf documents on computer, mobile or external data storage (such as USB flash drive) for personal use and only for the length of time you are actively studying the course.

• print one copy of the documents available for printing, for personal, non-commercial transitory viewing only.

This is the grant of a licence, not a transfer of title.

Under this licence you may not:

• modify, reproduce or publish any of the course content or materials

• use the materials for any commercial purpose

• redistribute or share the materials with anyone either digitally or by hard copy (they are solely for the registered student’s personal use)

• remove any copyright from the materials;

• retrieve, display or print any course content for anyone (they are solely for the registered student’s personal use)

• share your login details with any other party

• permit or enable a third party to do any of these acts.

All content of our Services and Products remains our Intellectual Property.
Licences are granted for 2 years unless otherwise agreed or specified. This licence shall automatically terminate if you violate any of these restrictions and may be terminated by Study Smiles Ltd at any time.

Upon completion of the course or upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Schools Packages

​

Bespoke packages for schools will include their own individual Terms and Conditions which will be agreed during negotiations.

The courses and materials supplied by Study Smiles Ltd are provided on an ‘as is’ basis. Although every effort has been made to ensure the accuracy of our Services and Products, they may include technical or typographical errors.  Study Smiles Ltd does not warrant the accuracy, completeness or currency of our services and materials. The content of the pages of our website, courses and products is subject to change without notice.

We warrant that:

• we will use reasonable skill and care in making our Services and Products available to you and ensuring its availability to you for the time period permitted (usually 2 years).

• we have the right to permit you to use our Services and Products in accordance with these terms and conditions.

We do not give any other warranties in relation to our Services and Products. Specifically:

• we do not warrant the accuracy, completeness or currency of our services and materials.

• we do not warrant that our Services and Products will be continuously available or that your use of our services will be uninterrupted or error free.

• we do not warrant likely results or guarantee the achievement of specific grades for external exams.

• we do not warrant that our Services and Products will be free from infection by viruses or anything else with contaminating or destructive properties or that our services will be free from attack.

Study Smiles Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.  Accordingly, to the fullest extent permitted by law, we exclude all representations, warranties, conditions and other terms which but for these terms and conditions might have effect in relation to our Services and Products.

In no event shall Study Smiles Ltd be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use our Services and Products.

The inclusion of any links on our website or within our Services and Products, does not imply endorsement by Study Smiles Ltd of these sites. Use of any such linked third-party website is at the user’s own risk.

We reserve the right to update these Terms of Service. Any amendments will be published on our website.
